Collaborative Law is a way of dealing with separation and divorce that has been used in the United Kingdom for over 10 years. It enables parties to negotiate an amicable settlement through a series of round table meetings. The main advantage of this type of arrangement is that the parties agree not to go to Court with any of the issues.
The collaborative route is a creative rather than destructive way to achieve a mutually agreeable solution following a separation or the breakdown of the family unit. The outcome of the collaborative process is fully client-driven resulting in a fairer and more constructive solution than through court proceedings.
Collaborative Law encourages communication and helps maintain relationship, especially as parents if children are involved.
Each party must be represented by a specially trained collaborative lawyer. Ward Gethin Archer's family department include trained collaborative lawyers, please let us know if you are looking for a team member to undertake such instructions.
As Resolution members we are able to offer a useful factsheet on choosing the right process, which discusses your options when divorcing, dissolving a civil partnership or separating. You can download the factsheet by clicking here.
